On April 20, 2005, a San Diego jury awarded our clients in a sexual harassment case six million dollars in punitive damages on top of $850,000 in compensatory damages. The defendant, UltraStar Cinemas (Movie Theater Entertainment Group) knowingly allowed two of its managers, ages 32 and 22 respectively, to sexually harass the teenage plaintiffs based on sex and/or gender. At the time of the harassment, the four plaintiffs were minimum wage workers between the ages of 16 and 17. UPDATE: On July 15, 2005, trial judge John S. Meyer took away the damages verdict in favor of the four women, ordering a new trial on the amount of damages. The case is currently on appeal by both sides.

The Ultrastar case is the second major sexual harassment verdict for our clients in San Diego in recent years. In 2002, a San Diego jury rendered a $30.6 Million to six of Mr. Kay's clients in a sexual harassment case.  Their store director had harassed them for years, while their employer, Ralphs Grocery Company, a subsidiary of grocery giant Kroger, knowingly allowed the sexual harassment to continue. 

The $30 million sexual harassment jury verdict was the focus of nationwide media attention, resulting in a featured segment on ABC Primetime. 

The case was appealed by both sides, resulting in a published opinion by the Court of Appeal. In 2001, we also obtained a $5.45 million verdict in a whistleblower case against Peoplesoft.
