$6,850,000; Marcisz, et. al v. UltraStar Cinemas (2005); A San Diego jury awarded six million dollars in punitive damages plus  $850,000 in compensatory damages against the defendant, UltraStar Cinemas (Movie Theater Entertainment Group) for knowingly allowing two of its managers, ages 32 and 22 respectively, to sexually harass the teenage plaintiffs based on sex and/or gender. At the time of the harassment, the four plaintiffs were minimum wage workers between the ages of 16 and 17;

$30,600,000; Gober v. Ralphs Grocery Company (2002); The largest sexual harassment jury verdict in the United States; This result was from a re-trial after an initial $3.8 million dollar verdict in 1998 was vacated by the judge. The judge subsequently reduced the verdict to approximately $8 million. 

$5,450,000; Yarborough v. PeopleSoft, Inc. (2001); Whistleblower-Wrongful Termination case;

$3,850,000; Gober v. Ralphs Grocery Company (1998); The second largest sexual harassment verdict in California; Verdict vacated and new trial granted;

$3,450,000; Atkins v. Safeway Stores (1996); The third largest sexual harassment verdict in California;

$7,200,000; Weeks v. Baker & McKenzie (1994); The largest single plaintiff sexual harassment verdict in the United States; Also the largest attorney fee award ($1,800,000); Tried on Court T.V.; Resulted in a published Court of Appeals Opinion (1998) 63 Cal.App. 4th 1128;

PHILIP EDWARD KAY

Mr. Kay attended U.C. Berkeley and graduated with a degree in history. Before becoming an attorney, he worked as a fireman for the San Francisco Fire Department. Since 1981, Mr. Kay has worked exclusively on behalf of plaintiffs. Starting in 1990, Mr. Kay began working exclusively on behalf of civil rights plaintiffs. His practice focuses solely on employment and civil rights cases, including sexual harassment, racial discrimination, and whistleblower cases. He has won the largest sexual harassment verdict in the nation and the three largest sexual harassment verdicts in the state, including the published case of Weeks v. Baker & McKenzie where a legal secretary won a jury verdict of $7.1 million. In Yarborough v. PeopleSoft, Mr. Kay won $5.45 million for a whistleblower who was terminated in violation of public policy because she complained that PeopleSoft submitted false reports to the federal government. Most recently, in San Diego, in the Ultrastar Cinemas case he obtained a $6.85 million dollar award and in the case of Gober v. Ralphs he obtained an award of $30.6 million dollars, the largest sex harassment verdict in the history of the country, on behalf of six employees of Ralphs Grocery Company, a wholly owned subsidiary of the supermarket giant, The Kroger Company.

Ms. Peluso attended San Francisco State University where she graduated with a Bachelor of Arts degree. For over 16 years, Ms. Peluso has worked exclusively with Mr. Kay as his paralegal. Ms. Peluso worked on the Weeks, PeopleSoft, Gober, and UltraStar cases.
